dc.description.abstract | El papel de los órganos reguladores consiste en asegurar el correcto
funcionamiento de sectores esenciales para la vida económica y social
de un país, ya que poseen un carácter estratégico. En diciembre de
2013, la reforma energética trajo consigo una serie de transformaciones que, a casi cinco años de su implementación, siguen representando auténticos retos para la vida política, social y económica de nuestro
país. Introduciéndonos en materia procesal, el presente comprende la
reflexión en torno a la colisión de intereses jurídicos en la interpretación
de los órganos reguladores en materia de hidrocarburos en México. En
el caso particular, se analiza –bajo la perspectiva de la reforma constitucional en materia energética– concretamente en su artículo 282
-veintiocho, el fortalecimiento de la Comisión Nacional de Hidrocarburos (CNH)
y la Comisión Reguladora de Energía (CRE) y su transformación en órganos reguladores coordinados. Asimismo, se prospectan dos ejemplos
de posible colisión en la interpretación del artículo 27 de la Ley de Órganos Reguladores Coordinados y respecto del artículo 51 de la Ley de
Hidrocarburos y que dicha interpretación colisione con lo que determine
la CRE al otorgarle a un operador petrolero un permiso y lo que resuelva
e.g., la Agencia Nacional de Seguridad Industrial y de Protección al Medio Ambiente del Sector Hidrocarburos, también conocida como Agencia
de Seguridad, Energía y Ambiente (con el acrónimo ASEA). Finalmente,
a manera de prospección de una posible colisión inter-institucional se
prospecta el caso particular de las tareas de extracción de gas de lutitas, poniendo de manifiesto los riesgos ambientales, la competencia por
el agua, y los criterios divergentes de las distintas instituciones, todo ello
en manifiesta oposición a los alcances de la reforma energética puesta

dc.description.abstract | The role of regulatory authorities consist in insuring the proper functioning of essential factors for the economic and social life of a country, since
they have a strategic character. In December 2013, the energy reform
brought with it a series of transformations that, almost five years after
its implementation, continues to represent real challenges for the political, social and economic life of our country.Introducing us in procedural
matters, this paper includes the reflection on the collision of legal interests in the interpretation of the regulatory authorities on hydrocarbons in
Mexico. In the particular case, it is analyzed – under the perspective of
the constitutional reform in the energy sector – specifically in its article
28 – twenty-eight, the strengthening of the National Hydrocarbons Commission (CNH) and the Energy Regulatory Commission (CRE) and its
transformation in coordinated regulatory authorities. Likewise, two examples of a possible collision in the interpretation of article 27 of the Law
of Coordinated Regulatory Authorities and in relation to article 51 of the
Hydrocarbons Law are prospected and that this interpretation collides
with what the CRE determines when granting an oil operator a permit
and what it resolves eg, the National Agency for Industrial Safety and
Environmental Protection of the Hydrocarbons Sector, also known as
the Safety, Energy and Environment Agency (with the acronym ASEA).
Finally, as a prospect of a possible inter-institutional collision, the particular case of the shale gas extraction tasks is explored, highlighting the
environmental risks, the competition for water, and the divergent criteria
of the different institutions, all in clear opposition to the scope of the energy reform implemented in 2013 | es |
