La perspectiva objetiva de los derechos humanos y la visión diacrónica de los mismos en el sistema interamericano de protección

Abstract

El presente trabajo tiene por objeto analizar lo que representan los derechos humanos para el Estado de derecho, la perspectiva objetiva de los mismos y finalmente, la visión diacrónica de los derechos humanos, según la cual, las obligaciones de garantía, restablecimiento, reparación, indemnización e investigación de las violaciones a los derechos humanos no solo son actuales, sino que son inherentes al Estado de derecho y, por tanto, permanentes e irrenunciables.

This paper advances a doctrinal and conceptual inquiry into the normative position of human rights within the structure of the rule of law. It interrogates the objective juridical status of fundamental rights and situates them within a diachronic analytical framework that traces their consolidation across constitutional, regional, and international legal orders. The argument developed herein maintains that the obligations to guarantee, restore, repair, compensate for, and investigate violations of human rights are not contingent or temporally bounded duties, but rather intrinsic and constitutive elements of the rule of law itself. Accordingly, these obligations assume a permanent, inalienable, and non-derogable character, binding state authorities irrespective of political change, institutional reconfiguration, or shifts in interpretive paradigms.
