El interés de un menor con discapacidad. A propósito del auto de la Audiencia Provincial de Las Palmas de 28 de diciembre de 2015

Abstract

La Audiencia Provincial de Las Palmas de Gran Canaria, Sección Tercera, pone fin, en su Auto de 28 de diciembre de 2015, a casi tres años de interrogantes que rodeaban cuestiones fundamentales tales como el derecho a la vida y a la integridad física, los límites al ejercicio de la patria potestad y el alcance de las decisiones judiciales en materia de discapacidad. De esta forma, finaliza una controversia entre el derecho a la libre elección de los progenitores a que se intervenga quirúrgicamente a su hija menor de edad y el interés de la menor defendido por el Ministerio Fiscal relativo al acceso a una tecnología biotécnica que facilitará su integración social y profesional en el futuro. Este trabajo es el resultado del estudio de un caso particular que refleja una realidad social en la que la justicia ha tomado parte al haberse visto involucrado el interés de un menor. Siguiendo esta argumentación, las autoras desean acercar al lector a una situación en apariencia íntima y personal en la que diferentes operadores jurídicos han actuado de oficio con el fin de velar por los intereses del menor.

The Provincial Court of Las Palmas de Gran Canaria puts an end, in its ruling of December 28, 2015, to almost three years of questions surrounding fundamental issues such as: the right to life and physical integrity, the limits on the exercise of parental authority and the scope of judicial decisions on an a matter such as disability. In this sense, it is finally resolved the dispute between the right to exercise the free choice of the parents to decide if they want to submit their child to a surgical intervention and the best interest of the minor defended by the public prosecutor, as this access to a biotechnical technology will facilitate her social integration and professional future. This essay is the result of the study of a particular case where the interests of a minor have been involved reflecting a social reality in which justice has taken part. Following this argument, the authors wish to bring the reader to a personal situation in appearance but in which different legal operators have acted on its own initiative in order to ensure the best interests of the child.
