abstract = {La relación entre derecho y discapacidad viene marcada por la reacción social ante una diferencia biológica que es significada, es decir, a la que se le da un valor, en este caso una minusvaloración que impacta en la 
configuración de los derechos, incluidos los derechos humanos. 
El presente artículo hace un repaso del imaginario social en torno a la discapacidad, expresado en los modelos sociales y terminología en torno a la misma, y desde esta perspectiva muestra la correspondencia entre forma de ser percibido y acceso a derechos en el estándar internacional de Naciones Unidas.
Este recorrido muestra a través de dos elementos significativos, la terminología utilizada y los derechos que se reconocen, se niegan o se titubean, que estamos ante un proceso vivo, entre la invisibilidad, la marginación, lo asistencial y el reconocimiento de sus derechos en pie de igualdad con el resto de seres humanos que se logra, formalmente, con  la Convención sobre los Derechos de las Personas con discapacidad (en adelante Convención o CDPD). Y es un reconocimiento formal pues el impacto de la Convención en Naciones Unidas es aún poco significativo.},
abstract = {The relation between law and disability is given by the social reaction to a biological difference that is signified, through a social value system, in this case a devaluation that impacts on the configuration of rights, including human rights.
This article presents a review of the social imaginary around disability, expressed in social models and terminology around it, and from this per spective shows the correspondence between the way of disability is being perceived and the correspondence access to rights in the international standard of nations United.
The article shows through two significant elements, the terminology used and the rights that are recognized, denied or hesitated, that we are faced with a living process, between invisibility, marginalization, care and recognition of their rights in foot of equality with other human beings that is formally achieved with the Convention on the Rights of Persons with Disabilities (hereinafter Convention or CRPD) and is a formal recognition as the impact of the Convention on the United Na tions is still insignificant.},
