abstract = {La condición de la mujer en los tiempos primitivos es deteriorada, excluida del ámbito de la interpretación y creación del Derecho. Carente de personalidad jurídica, su participación en este ámbito quedó reducida a instar, a través de los mecanismos legales establecidos por el sistema, en pronunciamientos legales de los juristas, el pretor o el mismo emperador. En las diferentes etapas históricas de Roma, son recurrentes las limitaciones y prohibiciones efectuadas hacia la mujer. En el presente trabajo, analizaremos la literatura jurídica que muestran como la condición jurídica de la mujer en el Derecho Romano cambió a la par que las costumbres y los tiempos y nos centraremos en el estudio de la capacidad jurídica de la mujer.},
abstract = {The condition of women in early Roman times is clearly one of inferiority,
being excluded from the realm of legal creation and interpretation. Lacking
legal personality, legal participation in this field was limited to petitioning
the pretor, or indeed the emperor, through legal pronouncements of jurists
in established legal channels. Throughout the different stages of Roman
history, the limitations and prohibitions affecting women are a recurring
feature. In this Paper we will analyse legal literature that shows how the
legal status of women in Roman law changed in line with changes in customs and times and we will focus our study on the legal capacity of women.},
